Commissioners Hear City Plan to De-Annex Dalby Unit

Jurors will receive cash payment

The Commissioners' Court met in a regular meeting on Monday July 9, 2012, with Judge Lee Norman calling the meeting to order.  Commissioners from all four precincts were in attendance along with other county officials.

The Court heard an update from City of Post Mayor Thressa Harp-Baker.  The Mayor, with supporting information from City Manager Arby Taylor, reported that the city will consider de-annexing The Giles W. Dalby Correctional Facility.  The federal census completed in 2010 included the facility, and thus inmates, as a part of the city population.  As a result, the population rose above 5,000, which acts as a threshold for various State regulations.

Taylor reported that the State of Texas would thereby require inspection of all buildings under construction which include electrical or plumbing systems.  Additionally, regulations from the Texas Commission on Environmental Quality would go in to effect.  The burden of these additional regulations is the primary driver for the City to consider the de-annexing of the unit.  If the de-annexing takes place, the City would still be able to pass a resolution allowing the continued providing of utilities to the facility at city rates.  No action was taken by the Court, but Judge Norman asked that the City wait to take any action.  The full impact on the county is unknown at this time.

In other business on the agenda, after approving minutes from the previous meeting, a number of written reports were brought before the Court and approved as presented.  These included reports as follows: Treasurer, Budget Usage & Analysis, Tax Collector & Assessor, Senior Transportation, Justice of the Peace - 1, AgriLife Extension - Jones, AgriLife Extension - McDonald, County Jail Indigent Care - May 2012, Letters from Garza Central Tax Appraisal District notifying the court of the Public and Board of Directors meetings, Texas Department of Licensing and Regulation - Letter of Approval of Elevator, and misc bond fund reports.  Following the approval of reports, the recent accounts payable for the precinct and county accounts were ordered to be paid as a part of more standard business.

For the next order, the Commissioners presented Linda Puckett and Pat Cruse with a Distinguished Service award for "outstanding preservation work accomplished in the 2011 year of service".  Read more in the related article.

In additional standard business, the Court approved a sealed, unsolicited offer for a piece of county property, discussed and approved a partial county burn ban, and approved two applications for public assistance totaling $382.57.  More information on the partial burn ban can be found in a recent story here on The Garza Post.

After recess, the Commissioners heard and approved a proposal to pay jurors in cash rather than by check to prevent a backlog of outstanding checks.  The first jury panel to receive cash as they checked-in for duty was the panel that reported on Tuesday, July 10.  Treasurer Ruth Ann Young said the jurors will receive cash on the first day and be paid by check for additional days of service after the jury is empaneled.   

The court approved the directing of receipts and payments from counties contracting with the Garza County Jail to the County Treasurer rather than the intermediary Sheriff's office.  Next they approved renewal of the annual property insurance coverage for $32,758 as presented by the Texas Association of Counties.

To close, line item transfers and budget amendment requests were approved, an upcoming engineering meeting was noted on the heating and cooling project, public comments were held, and an alert was given on the upcoming 2013 budget work.
