In a decision Monday, December 12, Garza County Commissioners' Court passed an order prohibiting certain fireworks in unincorporated areas of Garza County beginning December 15 and ending January 1, 2012.

Fireworks of any kind are prohibited within the city limits.

The order states that the Commissioners Court of Garza County “has determined that the normal danger of fire in the unincorporated areas of Garza County is greatly enhanced by the extremely dry conditions now existing.”

The order prohibits the use of fireworks classified as “skyrockets with sticks” and “missiles with fins” in any portion of the unincorporated area of Garza County.

The order does not prohibit “common” fireworks, small in size and classified as Class C explosives or large fireworks devices designed primarily to produce visible or audible effects, classified as Class B explosives.

According to the order “a person commits an offense if the person knowlingly or intentionally violates a prohibition established by this order.  An offense under this order is a Class C Misdemeanor.
